Court Dismisses Suit To Reinstate Impeached Adamawa Governor Nyako



A High court sitting in Yola, presided over by Justice Bilikus Bello Aliyu has dismissed a suit filed by former gover Murtala Nyako seeking to be reinstated following his impeachment by the Adamawa State House of Assembly.
Justice Aliyu stated that the case Nyako brought before her was an abuse of court process as three suits were pending before courts of law on the same issue.
“This suit is an abuse of this court and courts should protect themselves from abuse,” she said.


She upheld the argument of the first respondent’s councel, Mr. Leonard Zidon, who argued that the same case was pending before three high courts making it an abuse on court process, although earlier on Justice Aliyu had sadjudged  that Nyako’s right was infringed upon by the respondent as provided in section 36 of the 1999 constitution of Federal Republic of Nigeria as amended.
The judge said “I can not contuine with this case as the court runs concurrently, we will not encourage litigants abusing court processes.”
